Why no open competition
Single Suppliers Intellectual Property Exclusive Rights
Published justification

The following rationale supports the proposed direct award under Schedule 5 of the Procurement Act 2023 on the grounds of the novelty of the service and King’s College London having intellectual property rights in delivering the MedTech Venture Kickstarter as implied in the Innovate UK grant offer letter and thus there leaves no reasonable alternatives other than for King’s College London to deliver the programme. This approach is in accordance with Section 41 by reference to paragraph 2(a) and paragraph 5(a) and (b) of the Procurement Act 2023.
