- Why no open competition
- The procurement falls outside the scope of application of the directive
- Published justification
The Barco weConnect solution is the only SaaS solution that provides ALL of the functions
for remote teacher and student engagement required by Jisc:
- Teacher view with students split across multiple screens, with configurable groups of
students on each screen.
- Ability to setup different room configurations within software, eg virtual classroom,
collaboration room and hybrid classroom.
- Polls, quizzes and student questions
- Participation analysis by student
- Connection of additional audio and video inputs for concurrent use.
- The ability to manage all of the above through a single web interface.
Therefore we are clear that it falls within the regulation justification 32 b) ii) where services
can be supplied only by a particular economic operator as competition is absent for technical
reasons.
- Review procedure
Jisc Services Ltd will incorporate a standstill period at the point information on the award of the contract is communicated to suppliers. This notification provides information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for suppliers to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 article 91 provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
