The services can be provided only by a particular economic operator for the<br/>following reason:<br/>protection of exclusive rights, including intellectual property rights<br/><br/>Is in accordance with PCR 2015 Regulation 32.5(b).<br/>"For additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire<br/>supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance" The OEM awarded the contract has the intellectual property for the equipment used within context of this contract and has been maintained and managed by the awarded supplier as the Original Equipment Manufacturer (OEM) and own the intellectual property associated with the equipment. This proprietary equipment cannot be modified by another company.
- Review procedure
Precise information on deadline(s) for review procedures: Any appeals should be promptly brought to the attention of the contact specified in Section I above, and will be dealt with in accordance with the requirements of the Public Contracts<br/>Regulations 2015. Any appeals must be brought within the timescales specified by the applicable law, including without limitation, the Public Contracts Regulations 2015. In<br/>accordance with the Public Contracts Regulations 2015, the Contracting Authority will also<br/>incorporate a minimum 10 calendar day standstill period from the date information on award<br/>of contract is communicated to tenderers.
