- Why no open competition
- The procurement falls outside the scope of application of the directive
- Published justification
Additional services have been required due to legislative updates and moving to a new corporate records management solution which highlighted complexities therefore the Authority will be relying on Regulation 72(1)(c) as the need for the change could not have been foreseen by a “diligent” Department and the changes do not affect the overall nature of the contract or exceed 50% of the value of the original contract.
- Review procedure
The Public Contract Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). The. authority will incorporate a standstill period (i.e. a minimum of 10 calendar days) before this contract is awarded.
