- Why no open competition
- Single Suppliers Technical Reasons
- Published justification
The proposed direct award is justified on the basis that competition is absent for technical reasons, in accordance with Section 41 and Schedule 5 of the Procurement Act 2023.
Competition is absent due to the existing bulk gas infrastructure installed and owned by the incumbent supplier. The current storage tanks, pipework, telemetry systems, and associated control equipment are specifically designed to operate with the incumbent’s supply arrangements.
The costs associated with replacing this infrastructure would be significant and would outweigh any potential savings that could be achieved through a competitive tender process. Changing supplier would introduce operational disruption and potential risks to continuity of supply during the transition period.
