Locum Educational Psychologists are required to complete bespoke psychological assessments contributing to the Council's statutory duties in relation to Education, Health and Care Plans.

Professional application of bespoke psychological services to fulfil some aspect of the Council's statutory duties relating to EHCNAs towards decision making around issuing EHCPs.

Work involved: Consultation, observation, administering a range of psychological assessments (where feasible), interpretation and analysis of data, identifying and outlining objectives and recommendations. Liaising with setting, parents / carers and other services to co-ordinate and support where deemed helpful in the course of their reportage.

Work commissioned is bespoke pieces of assessment. Additional information: There is a national shortage of EPs. It is therefore incredibly difficult to locate and commission suitably qualified and experienced EPs and Locum EPs.

The Council is implementing a number of parallel strategies that will reduce the level of Needs Assessments and external resource over this 5 year period.

Extensions: Initial 2 year contracts offered with 3 x 12 month options to extend. Up to 5 years in total, should extensions be exercised.

The regulation being relied upon is regulation 32(b)(ii), (iii) e.g. where:

Competition is absent for technical reasons e.g. no reasonable alternative
substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement;

Review and risk notes

Review procedure: Cheshire East Borough Council will incorporate a standstill period at the point that the information of the contract is communicated to tenderers. That notification will provide full information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 (SINº 102) provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules total action in the High Court (England, Wales and Northern Ireland).

Publisher note: There are 14 contracts to date to be agreed/updated. Depending on extensions taken up or not subject to resource being available, over time, there may be additional EP's commissioned under this VEAT to the max value of £2.5m over the full potential 5 year period.
