Review and risk notes
Review procedure

This procurement is governed by the Public Contracts Regulations 2015 and provides for economic operators who have suffered, or who risk suffering, loss, or damage, as a consequence of an alleged breach of the duty owed in accordance with Regulation 91 to start proceedings in the High Court.. A standstill period will commence at the point information on the award of the contract is communicated to tenderers. That notification will provide information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into.. Any proceedings relating to any perceived non-compliance with the relevant law must be started within 30 days, beginning with the date when the economic operator first knew, or ought to have known that grounds for starting the proceedings had arisen. (A court may extend the time limit to 3 months, where the court considers that there is a good reason for doing so)..

    • Change The intention is to modify the existing contract by the last permissible 12 month extension (with a break clause inserted at 6 months) to allow the re-procurement of this contract to be concluded. Additionally, it is the intention to modify the estimated value of the contracts to £72m which will allow for essential projects to be delivered during the proposed extension period., Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: When the MTC Multi Trade Contracts were procured in 2020, the Contracting Authority considered the Estate’s size, age, condition, and expected needs using the information available at the time. This included maintenance, refurbishment and replacement where needed. Since then, parts of the Estate have deteriorated more quickly or severely than could reasonably have been expected. Storms and severe weather have added to this, increasing the need for refurbishment and replacement beyond what was anticipated at tender. The modification allows essential work to continue so the Estate remains safe, resilient, and operational. It also supports work on assets at the end of their useful life, as well as refurbishment and reconfiguration. The contracts’ overall purpose remains unchanged. The modification covers work already within their scope but needed on a greater scale than could reasonably have been foreseen
