Publisher note: This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR) Health Care Services Regulations 2023. For the avoidance of doubt, the provisions of the Procurement Act Regulations 2024 do not apply to this award. The urgent nature of this modification was not foreseeable by or attributable to the relevant authority. The NHSE further consultation on the NHS Standard Contract was not finalised until 8th May 2025. The new service conditions allowed the commissioner to set an Indicative Activity Plan for the Contract Year where an IAP could not be agreed after a period of time. Because the contract ends part way through the year (31/08/2025) and the financial position an urgent modification has been put in place to allow the commissioner to manage activity for the year and to ensure there is no significant risk to patients who have planned surgery with the provider. This award has no impact on market opportunities for these services to potential new providers, a Direct Award Process B may still be undertaken if a new provider wishes to provide these services to Norfolk and Waveney Service Users. Any providers who are reading this notice and wish to provide the same services are welcome to contact the commissioner at nwicb.contractsandprocurement@nhs.net This decision was made by Associate Director of Contracting and Procurement and approved by Norfolk and Waveney ICB Executive Director of Finance on 29th August 2025. No conflicts or potential conflicts of interest were declared.

    • Change Contract to be extended for 7 months from 31st August to 31st March 2026 by urgent modification. The estimated value of modification £1,844,638. This value is greater in comparison to previously due to the new IAP rules and increased activity levels. It has not been possible to agree an IAP with provider as per revised NHS England 25/26 Service Conditions by 30th June 2025. Due to the time this has taken, Norfolk and Waveney ICB have been unable to start re-accrediting the provider without a clear plan for current activity. This Urgent Award will allow Norfolk and Waveney ICB to manage activity for the entirety of the 2025/26 Financial Year as the contract is due to expire on 31st August 2025. This Urgent Award has no impact on market opportunities for potential new providers, a Direct Award Process B can still be undertaken. (Any providers reading this notice who wish to provide the same services may contact the commissioner at nwicb.contractsandprocurement@nhs.net) Original contract 01/04/2023 - 31/03/2025 (including 12 month optional extension) Previous modification used to extend from 1/04/2025 - 31/08/2025, Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: It has not been possible to agree an IAP with provider as per revised NHS England 25/26 Service Conditions by 30th June 2025. Due to the time this has taken, Norfolk and Waveney ICB have been unable to start re-accrediting the provider without a clear plan for current activity.
