- Why no open competition
- The procurement falls outside the scope of application of the directive
- Published justification
This training is essential to organisational service delivery and is a statutory duty. In this instance, changing to a new system would have
significant practical, resource and cost of change implications. Training of 170 to 200 facilitators to undertake the delivery of required learning, in a single year, brings risks to staff and client safety whilst maintaining "business as usual". For these reasons, there are no financially, administratively reasonable or viable alternatives available.
- Review procedure
An economic operator that suffers or risks suffering loss or damage attributable to a breach of duty under Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or Court of Session. In general, a claim for an ineffectiveness order must be made within 10 days of the date on which the VEAT Notice is published in the Find a Tender Service
