The Authority proposes to award a contract directly under section 41 of the Procurement Act 2023, relying on the justification of extreme and unavoidable urgency in Schedule 5, paragraph 13.
There were a number of existing Business Analysts delivering services under a Home Office central contract (via a subcontracting arrangement) who were released from the incumbent supplier with only 20 days’ notice. These services are essential to the delivery of HO priority design work. The incumbent provider has been unable to secure suitable replacement services to maintain continuity of delivery. Insufficient or unsuitable resource increases the risk of delivery delay against already tight programme timescales.
The supplier’s rates have been competitively tendered during to support the Home Office Central Contract and these rates have been transitioned to a direct award contract.
