- Why no open competition
- Single Suppliers Intellectual Property Exclusive Rights; Single Suppliers Technical Reasons
- Published justification
Hitachi is the only supplier that can provide the required works for renewal of the System Management Centre (SMC) as they have exclusive ownership of the intellectual property rights (IPR) associated with the design, software and hardware of the Automatic Train Control (ATC) signalling system currently deployed at Docklands Light Railway.
The SMC is a subsystem of the ATC signalling system.
Access to Hitachi's software or source codes by other suppliers would invalidate the safety assurances given by Hitachi, in its capacity as the signalling design authority, that the system is and continues to be fit for purpose and safe to operate.
