Why no open competition: Extreme urgency brought about by events unforeseeable for the contracting authority/entity and in accordance with the strict conditions stated in the directive
Published justification: Notice of immediate CQC cancellation of registration meant there was 6 hours to mobilise caretaking arrangement. Most suitable provider, and to minimise disruption to services, was another practice co-located in the same building. The Urgent Contract award was made under regulation 14 i.e. contract had to be awarded rapidly due to unforeseeable circumstances not attributable to the ICB. Failure to act immediately would have posed an immediate risk to patient safety.
