- Why no open competition
- Additional deliveries by the original supplier ordered under the strict conditions stated in the directive
- Published justification
NMIS have had the current loan equipment on site for >2 years. In addition to significant sunk costs for commissioning and training, layers of software have been installed onto the equipment, some of which is proprietary, along with third party hardware additions. The University considers that a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
- Review procedure
An economic operator that suffers, or risks suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland)Regulations 2015 (SSI2015/446) (as amended) may bring proceedings in the Sheriff Court or the Court of Session.
Publisher note: Subject to the passing of the VEAT period, the University intends to enter into an agreement with the noted supplier on 16th March 2021. (SC Ref:649915)
