Why no open competition: The procurement falls outside the scope of application of the directive
Published justification: The need for this variation has been brought about by the unexpected extension of the requirement for cleaning and security staff, at Silvan House and the responsibility for its facilities management was due to be adopted by Scottish Government in September 2022 (as the largest tenant in the building) when the lease of the building was due to be renewed for a further 10 years. However, Ministers rejected the business case for renewing a commercial lease and instead agreed a temporary extension of one year. Therefore, the responsibility for facilities management at Silvan House remains with FLS.
