This is a Voluntary Ex Ante Transparency (VEAT) Notice. The National Waiting Times Centre Board (Golden Jubilee) intends to enter into a one year contract with Trane UK Ltd as the only supplier capable of meeting the Board’s requirements. In accordance with our interpretation of the Public Contracts Regulations 2015, the required service capability can only be provided by a particular provider for technical reasons. The Board requires ongoing maintenance and support of the Hospital and Eye Centre chiller plant and associated control systems to ensure the safe, efficient and compliant operation of critical cooling infrastructure. The system is essential for monitoring and controlling temperatures, alarms, plant performance and environmental conditions that support patient care. The services required include planned preventative maintenance, inspection, testing, software backup and support activities necessary to maintain system reliability and ensure continued performance of the chiller plant and associated controls.

Why no open competition: The procurement falls outside the scope of application of the directive
Published justification: Under Regulation 33(b)(ii) of the Public Contracts (Scotland) Regulations 2015, competition is absent for technical reasons. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that Trane UK Ltd is the only commercially available able to provide the Building Management System for the management and control of the main chiller plant for the Hospital and the Eye Centre in line with all statutory requirements and healthcare guidance. The existing BMS operates on Trane's proprietary Tracer Summit platform, a closed-protocol system for which Trane UK Ltd retains the exclusive access,
and permissions required to modify and support the system. No alternative supplier can access or amend the system without Trane UK's direct involvement. Replacing or re-engineering the existing solution would result in disproportionate cost and potential risk on the Board's ability to maintain critical environmental controls required for the safe operation of healthcare facilities.
