Why no open competition: The procurement falls outside the scope of application of the directive
Published justification: The contract is to service and maintain a highly specialised piece of scientific equipment, dedicated scanning transmission electron microscope, a suite of only a handful such instruments in existence in the world, by its manufacturer, Nion Company. Given the highly specialised nature of this equipment, and the provision of spare parts service exchanges under this service contract quotation, no provider other than Nion could offer this level of service and maintenance. Nion Company manufactures highly customised and unique electron microscopes, which no third party could service. Specificities of the instrumentation that are currently unique to Nion include: ultra-high vacuum construction, high precision proprietary electronics, ultra-high energy resolution monochromated electron illumination system.
