- Why no open competition
Extreme urgency brought about by events unforeseeable for the contracting authority/entity and in accordance with the strict conditions stated in the directive
- Published justification
The contractor currently providing these works used the break provisions in the contract to end the service prematurely.
This unforeseeable event has resulted in the Association having to urgently appoint a new contractor to maintain the service to meet their regulatory requirements.
The Association entered into negotiation with the second placed tenderer from the original procurement, who agreed to comply with the original contract requirements at the same rates tendered.
There were no other bids received from service providers when the contract was originally tendered in 2021 therefore options for negotiating with others was limited considering the timescales.
