- Change The Council has experienced a number of unforeseen fire alarm repairs during the initial 2 year contract period. We are now actively progressing the re-procurement of the fire alarm support contract, and will ensure there is a greater provision within the new contract for repairs. To ensure continuity of service and allow sufficient time for a new tender process to be undertaken, it is necessary to extend the contract to ensure this statutory service is still able to be undertaken. The contract had a clause within it for pricing to be fixed for 12 months then the price shall be calculated in accordance with the percentage increase or decrease against the previous September’s Retail Price Index (excluding mortgages), published by the Office for National Statistics. Based on this the year 2 value for the contract increases from £63,410.00 to £64,678.20 based on the 2% RPIX value of September 2024 The year 3 value for the contract increases until £67,524.04 based on the 4.4% RPIX value of September 2025. The year 3 value has also been based on the 4.4% RPIX increase of September 2025 which increases to £70,495.10. The total contract value including RPIX increases if £266,107.34 The contract value if all extensions are utilised is £266,107.34. Swindon Borough Council are increasing this value up to £292,718.07 (10% increase on the initial contract value) contract spend. This allow the department to remain compliant with its statutory obligations whilst the new tender process is undertaken., Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee. The Public Contracts Regulations (PCR) 2015 set out the conditions for how contract modifications can lawfully be applied under Regulation 72. The grounds proposed for progressing this modification is under Regulation 72 (1) (f) and 72 (5), As well as 72 (7) with regards to using the RPIX figures within the modification. An increased number of repairs were required with fire alarms during the contract duration mainly within the corporate estate 72 (1) (f) - where paragraph (5) applies. 72 (5) This paragraph applies where the value of the modification is below both of the following values:— (a)the relevant threshold mentioned in regulation 5, and (b)10% of the initial contract value for service and supply contracts and 15% of the initial contract value for works contracts, Justification: The contract modification does not exceed 10% of the initial contract value and does not alter the overall nature of the contract. 72 (7) (7) For the purpose of the calculation of— (a)the price mentioned in paragraph (1)(b) and (c), and (b)the values mentioned in paragraph (5)(b), the updated figure shall be the reference figure when the contract includes an indexation clause. Justification: The increase in price includes RPIX increases against the previous Septembers figures. The contract will expire when the new contract is awarded rather than at the end of the full 2 year extension period.
