Published requirement description

The purpose of this Framework Agreement is to allow Kirklees Council to block purchase beds within residential care and nursing home settings for short term, non-permanent stays. Short term stays are necessary to free up hospital beds, when Service Users are deemed medically fit to be discharged from Hospital but their long term care requirements/packages of care are not immediately available. These beds may also be utilised by people in

community settings who require step up provision, for example following a carer breakdown, respite provision or to prevent hospital admissions. Previously the Council has entered into

Contracts with care home providers such as the Choice and Recovery Beds, Winter Pressure Beds, and Discharge to Assess Beds. These types of Contracts will in future be competed

from this Framework Agreement. The Council is working towards adopting a trusted assessor model of assessment of needs into the Contracts competed from this Framework Agreement. Where a trusted assessor model is required this will be detailed in the

specification and further competition documentation for that particular contract.

As this Framework is for short term stays, the residential care and nursing homes for the purpose of this Framework must be located within the geographical boundaries of the Kirklees District as;

i) it is not practical to transport a person seeking care to residential care and nursing homes outside the Kirklees district;

ii) the social workers would not be able to check on a person outside of the Kirklees district;

iii) GP registrations for such persons are restricted only to the Kirklees district.

Review and risk notes
Review procedure

The contracting authority will incorporate a minimum ten (10) calendar day standstill period at the point that information on the conclusion of the Framework Agreement is communicated to tenderers. This period allows any unsuccessful tenderer(s) to seek further debriefing from the contracting authority before the conclusion of the Contract(s). Such additional information should be requested from the address at I.1 of this notice. If an appeal regarding the conclusion of the Contract(s) has not been successfully resolved, then the Public Contracts Regulations 2015 (SI 2015/102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).Any such action must be started within thirty (30) days beginning with the date when the aggrieved party first knew or sought to have grounds for starting the proceedings had risen. The Court may extend the time limited for starting proceedings where the Court considers that there is a good reason fordoing so, but not so as to permit proceedings to be started more than three (3) months after that date. Where the Contract has not been concluded, the Court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages. If however the Contract(s) has been concluded, the Court may only award damages or, where the contract award procedures have not been followed correctly, declare the Contract(s) to be ineffective.

Publisher note: Tenderers are advised this process is a competitive procurement exercise conducted in the form of an Open Procedure under the Public Contracts Regulations 2015. The Authority do not commit to following the procedure precisely and reserve the right to vary the procedure from that of the Public Contracts Regulations 2015 where necessary, as detailed within the Information and Instructions for Tenderers. If the Contracting Authority decide to enter into a framework agreement with any successful Service Provider, this does not mean that there is any guarantee of subsequent contracts being awarded. The Contracting Authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs).
