Maintenance and Response 2 Framework
Authority: National Highways Limited (Central government)·Consortium: 2 public authorities
What is being bought7 lots · detail below
Published requirement descriptionThis notice relates to the procurement of the Maintenance and Response 2 (M&R2) framework, which will deliver maintenance and reactive services for National Highways, across the strategic road network (SRN). The SRN is one of the biggest and most important pieces of infrastructure in the country, and is comprised of more than 4,500 miles of motorways and major A roads which are at the core of our national transport system.
The M&R2 framework will consist of seven location based lots and, following the procurement exercise, a single supplier will be appointed to deliver the services in each location. Each successful supplier will also be appointed to an overarching framework agreement, to provide resilience across the network in the event of supplier failure.
National Highways is looking for suitable suppliers to provide and undertake:
- cyclical maintenance,
- reactive maintenance to address urgent needs,
- incident response,
- severe weather operations and winter maintenance,
- operational roadside technology maintenance and schemes, and
- selected asset renewal works including but not limited to; road markings, soft estate, lighting, road signs, road restraint systems and fencing.

Further contract and procurement details can be found in the conditions of participation documents published on the National Highways eSourcing Portal, specifically the Information Memorandum.
- How the procedure runs: The procurement will follow the competitive flexible procedure (CFP) in accordance with the Procurement Act 2023 and associated Procurement Regulations 2024. The CFP has been selected as it provides National Highways with the opportunity to achieve a more effective, flexible, and value-driven procurement process, ultimately leading to better project outcomes. The CFP will incorporate two main competitive stages: - conditions of participation stage where applicants will be shortlisted based on their legal and financial capacity and technical ability, and - tender stage where applicants shortlisted at the conditions of participation stage are invited to submit a tender, the assessment of which will identify the most advantageous tenders (MAT). A full description can be found in the conditions of participation documents published on the National Highways eSourcing portal, specifically the Information Memorandum. To support suppliers in navigating the Framework and the associated documentation, the procurement process will include a tender launch presentation. This will ensure the conditions of the framework are fully understood, including the commercial model.

How this framework works
From the published notice- Type
- Closed framework
- Call-offs
- call-offs may be awarded directly or by further competition
- Places
- up to 7 suppliers
- Framework period
9 yrs 6 mo from 6 Jan 2028, The duration is justified to ensure the ability to undertake secondary competition between M&R2 suppliers in the event a M&R2 supplier is no longer able to fulfil their obligations under their M&R2 lot contract i.e. poor performance or supplier failure. Therefore the framework must be in place for at least as long as the last expiry date for any planned M&R2 lot contract, each of which are anticipated to run for approximately 8.5 years from the starting date (which are staggered over the course of circa 12 months).
The M&R2 lot contracts duration have been designed with consideration to the following factors:
- promotion of investment in innovation, people, equipment, and collaborative relationships, giving overall best value and maximising productivity,
- previous market engagements show that the supply chain prefers a contract duration of longer than 4 years,
- resource drain (for all parties) for future procurement activity planned around the same time as M&R2's successor.
- Supplier levy on call-offs (max %)
- There are no fees charged to suppliers.
Published description of the framework
At framework award, call-off contracts will be awarded in accordance with the tender documents and taking account of the total tender scores, award rules and preferencing.
During the framework operation there will be two mechanisms for the reallocation of work:
- Award without competition
There will be a process for award without further competition should a call-off contract fail and work on the network is needed during the period of running a secondary competition, or where the M&R2 programme itself is coming to expiry and it would not be practicable to run a secondary competition for such a short period. The contract documents will include the process of identifying the best supplier to accept the award without further competition
2.Secondary Competition
If, throughout the duration of the framework, a supplier is unable to deliver the requirements of their call-off contract, their contract may be terminated, and a secondary competition would be held to determine which other existing framework supplier is best suited to deliver the work for the remaining term of the M&R2 programme.
The total estimated framework value provided in this notice is greater than the aggregate total of the estimated value of all call-off contracts in this notice. The total estimated framework value includes a sum for inflation and a level of contingency across total framework spend. National Highways has included a contingency amount to accommodate costs in the event of reallocation of work (if needed) and necessary amendments to call-off contracts.

How this buyer will score bids.
The evaluation criteria and weights exactly as published on the notice, grouped by family (price, quality, social value and so on).
Published sub-criteria (2)
- Quality (including social value): 60%
- Commercial: 40%
Published award criteria (2)
- Quality (including social value): As part of the quality submission at tender stage, suppliers will be required to respond to a number of quality questions (including one or more social value questions) and each question will be weighted individually. The cumulative score given for questions will be used in a weighted value for money index methodology, as described in the Information Memorandum published on the National Highways eSourcing portal. More information on the weightings and scoring methodology will be detailed in the tender documents, following supplier shortlisting at conditions of participation stage.
- Commercial: The prices submitted by supplier within their commercial submission will be applied to pre-determined model services and schemes to determine a total tender price for each lot the supplier is tendering for. The total tender price will be used in a weighted value for money index methodology, as described in the Information Memorandum published on the National Highways eSourcing portal. More information on scoring methodology will be detailed in the tender documents, following supplier shortlisting at conditions of participation stage.
- Price carries 40 of 100 points: a 10% discount moves about 4 points. The method statement decides this lot, not the discount.
- “Maintenance and Response 2 Framework” is a framework: the contest is a place on its panel, up to 7 suppliers, not a single contract: call-offs may be direct or by further competition.
Price arithmetic assumes straight proportional scoring; the tender pack may use another formula.
