Why no open competition

The works, supplies or services can be provided only by a particular economic operator due to absence of competition for technical reasons

Published justification

On 31st March 2022 YPO published Prior Information Notice (Notice Reference: 2022/S 000-008723) for the Supply of Exercise Books and Paper, the aim of which was to engage with and find potential providers. In response to the PIN notice YPO were in communication with several suppliers about this opportunity. All but one provider decided they could not meet the requirements. After extensive engagement with customers, as well as paper and exercise books providers, both within the UK and overseas market, YPO did not identify suitable suppliers, apart from one, who could meet YPO's technical specification and delivery requirements, specifically volumes with peak periods, turnaround and lead times. Therefore, YPO would like to award this framework through Regulation 32 in Public Contract Regulations 2015 on the grounds that:

"32 (b) where the works, supplies or services can be supplied only by a particular economic

operator for any of the following reasons:—

(ii) competition is absent for technical reasons"

Publisher note: YPO will incorporate a standstill period at the point of notification of the award of the contract is provided to all bidders. The standstill period will be for 30 calendar days, and provides time for potential providers who did not come forward at the time of market research and PIN being published to do so at this time if they can meet YPO's requirements and to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
