- Why no open competition
- The procurement falls outside the scope of application of the directive
- Published justification
Contract was awarded without prior publications in Find a Tender in accordance with Regulation 50(e) of the Utilities Contracts Regulations 2016.
The contract involves upgrade of existing WiFi equipment currently provided by the named contractor (Icomera UK Ltd.) to deliver additional in-train entertainment services. Upgrade is required to reflect new developments in technology which would enhance functionality of overall WiFi system.
Changing the supplier would compel SWR to disproportionate technical difficulties in operation and maintenance including incompatibility issues and additional cost of major refit required on the rolling stock to accommodate a different equipment type.
