Published requirement description

LHC Procurement Group Limited (LHCPG) is procuring the Refurbishment and Modernisation Scotland Framework Agreement (RM4S) on behalf of the Scottish Procurement Alliance (SPA).

LHCPG is acting as the Contracting Authority and central purchasing body for this procurement.

The Framework is being procured solely for use in Scotland and will provide eligible public sector organisations with a compliant and flexible route for the delivery of refurbishment, improvement, repair, maintenance and modernisation works, goods and associated services across residential and non-residential buildings.

The procurement is being conducted using the Open Procedure in accordance with the Procurement Act 2023 and the Procurement Regulations 2024. When awarding Call-Off Contracts, eligible Clients and Partners must also comply with the Framework Agreement, the applicable Call-Off procedure and any other procurement legislation applicable to them.

RM4S builds upon the existing Refurbishment and Modernisation (RM3) Framework and has been developed following market engagement with suppliers and public sector organisations.

Feedback received through that engagement has informed the scope, Workstreams, Lot structure, value bands and regional arrangements. The Framework comprises the following Workstreams and Lots:

Painting and Decorating

Electrical Works, from zero to 500k

Electrical Works, 500k and above

Kitchens and Bathrooms, from zero to 500k

Kitchens and Bathrooms, 500k to 2m

Aids and Adaptations

Damp and Mould Remediation

Environmental and External Works, External Works

Multi-Disciplinary Works, from zero to 750k

Multi-Disciplinary Works, 750k to 2.5m

Multi-Disciplinary Works, 2.5m and above

Kitchens (Supply only)

Each Lot is divided into five regional areas covering North Eastern Scotland, Highlands and Islands, Eastern Scotland, West Central Scotland and Southern Scotland. Bidders may apply for one or more Lots and regional areas in accordance with the Procurement Documents.

Subject to there being sufficient Qualifying Bidders, LHCPG will appoint no more than 10 Appointed Companies for each Lot and regional area. Any Micro and Small Enterprise Reserved Allocation forms part of, and is not additional to, that maximum.

LHCPG will first identify the 10 highest-ranked Qualifying Bidders. Where the applicable allocation is already achieved within those positions, the 10 highest-ranked Qualifying Bidders will be appointed without adjustment. Where it is not achieved, the highest-ranked remaining qualifying Micro Enterprises or Small Enterprises will be included as necessary, replacing the lowest-ranked selected Bidders not required to satisfy the allocation.

Any unfilled allocation will revert to the general ranking. The Framework will not operate a reserve list.

The Framework is structured to support participation from organisations of different sizes and capabilities through its Workstreams, value bands, regional areas and applicable Micro and Small Enterprise Reserved Allocations. All Bidders will remain subject to the same published qualification, compliance, quality, evaluation and appointment requirements.

RM4S is intended to support the delivery of high-quality and compliant solutions, sustainable supply chains, environmental improvement, social value, community benefits, Fair Work and proportionate innovation. Detailed technical requirements, eligibility provisions, award criteria, appointment methodology and Call-Off procedures are set out in the Procurement Documents.

  • The authority expects to re-tender this requirement around 1 Feb 2031, 23:59 GMT, LHCPG may procure a replacement or successor framework when this Framework expires. The scope, structure, timetable and procurement route for any future arrangement will be determined nearer the time and will be subject to applicable procurement legislation..
  • No preliminary market engagement: A separate UK2 Preliminary Market Engagement Notice was not published. Advance notice of the proposed framework was provided through a Prior Information Notice published on Public Contracts Scotland (PCS) and transferred to Find a Tender: FTS notice: 2026/S 000-020262 PCS reference: MAR551114 Preliminary market engagement was subsequently undertaken by the Scottish Procurement Alliance on behalf of LHC Procurement Group through three in-person sessions with existing RM3 suppliers, other suppliers interested in RM4S, and SPA Partners as existing or potential framework users. The sessions gathered feedback on the existing framework, Partner requirements, supplier experience, proposed scope, workstreams, lot structure, value bands and estimated framework value. This feedback informed the development of the RM4S scope, structure and procurement documents. As advance notice had been published and preliminary market engagement completed, a separate UK2 notice was not published.

The registrations, accreditations and certifications required vary by Lot. Full details of the applicable minimum requirements are set out in the Procurement Documents available through the In-Tend eTendering portal. Bidders must complete the four Selection Questionnaires within In-Tend, which contain selection questions aligned with the SPD (Scotland). The applicable requirements will be assessed on a pass/fail basis.

Procurement Documents and Selection Questionnaires are available at tsupplier.in-tend.co.uk/lhc/tenders/details/… ↗

  • Economic & financial standing

Bidders must demonstrate sufficient Economic and Financial Standing to perform the Framework and the Lot(s) for which they submit a Tender. EFS will be assessed separately for each Lot as a pass/fail Condition of Participation and will not form part of the scored quality or price evaluation.

Bidders must complete and submit Appendix 6 – RM4S FVRA Workbook and all supporting financial information required by the Procurement Documents. The completed workbook must include the Bidder’s supplier details, declarations, applicable financial metrics, supplier type and confirmation of every Lot for which the Bidder is applying.

Each Lot has been assigned a Bronze, Silver or Gold financial information route. Bronze Lots use a proportionate basic financial information route. Silver Lots require the published Standard or VCSE financial metrics and supporting evidence. Gold Lots require the Silver information set together with any additional analysis, trend information, mitigation evidence, resolution-planning information or financial assurance evidence specified in the Procurement Documents.

Bidders must select the Standard or VCSE route, as applicable. LHCPG may verify the selected supplier type and request supporting evidence.

  • Technical & professional ability

Bidders must demonstrate that they have the technical and professional ability, relevant experience, capacity, resources, systems and competence required to deliver the works, goods and/or services covered by the Lot(s) and regional area(s) for which they are tendering.

The applicable technical and professional ability requirements vary by Lot and will be assessed on a pass/fail basis through the four Selection Questionnaires within the In-Tend eTendering portal, which contain selection questions aligned with the SPD (Scotland), and through the supporting evidence required by the Procurement Documents.

Bidders must provide all information, declarations and supporting evidence requested in the Procurement Documents. This may include evidence relating to relevant experience, technical capability, health and safety, environmental management, quality management, equality legislation, required accreditations and certifications, and any other Lot-specific mandatory requirements.

Where a Bidder submits a Tender as a consortium or relies on another entity’s technical or professional ability, resources, systems or certifications, the relevant information and evidence must be provided in accordance with the Procurement Documents.

A Bidder that fails to satisfy an applicable technical and professional ability requirement, mandatory pass/fail requirement or evidence requirement may be excluded from further assessment in respect of the affected Lot(s) and/or regional area(s).

Minimum: Full details of the minimum requirements that Bidders must satisfy to be considered eligible for appointment to each Lot and regional area are set out in the Procurement Documents.
What this means for your bid
  • Price carries 30 of 100 points: a 10% discount moves about 3 points. The method statement decides this lot, not the discount.
  • “Refurbishment and Modernisation (RM4S) - Scotland Framework Agreement” is a framework: the contest is a place on its panel, not a single contract: call-offs may be direct or by further competition.

Price arithmetic assumes straight proportional scoring; the tender pack may use another formula.

Question for the bid
This buyerLHC Procurement Group · this authority
The marketConstruction work (CPV 45) · Scotland
What to do with it
How often do SMEs win?
i

How often small and medium firms win.

Share of awards where the winner’s size is known.

The counts under this question show how many awards have a known supplier size.

Last 36 months.

Buyer: no supplier sizes published · market: division 45 · Scotland, n=102
—61%

No supplier sizes published for this authority.

How often do local suppliers win?
i

How often local firms win similar work.

Winners with a registered address in the delivery region, out of awards with a known address.

Local means the winner is registered in the region where that award was delivered. The market figure counts awards delivered in Scotland.

A local branch does not count if the registered address is elsewhere.

Last 36 months.

Buyer: no winner locations published · market: division 45 · Scotland, n=116
—42%

No winner locations published for this authority. Local means a registered address in the region where that award was delivered.

How long to a decision?
i

How long buyers here take to decide after bids close.

Middle value in days from the bid deadline to the award date, on competitions that published both.

Only decided tenders count, so slow ones still waiting are not in.

Last 36 months.

Buyer: no decision dates published · market: division 45 · Scotland, n=6
—96 days

Half of these awards have an award date within 96 days of the bid deadline.

How often single-bid or direct?
i

How often work is awarded with no recorded rival.

Direct awards and tenders where every published lot count shows one bid.

The market share is a minimum: some awards have no bid count.

Thin markets produce this too; it is not proof of a tailored specification.

Last 36 months.

Buyer: no awards on record · market: division 45 · Scotland, n=42
—7%

No awards recorded for this authority in this market.

How many bids this lot may attract.

The forecast uses similar past competitions. The bar shows either that forecast or past bid counts; the line below says which.

Each lot shows its own forecast based on its own category; forecasts for different lots of the same notice are not comparative.

Commercial price forecast
i

Where the award price may land.

The forecast uses similar awards and the buyer’s estimate. The band covers the middle half of likely prices.

No comparable awards for this lot yet.

A statistical guide from past awards, not a price to bid.

—Priced at call-off
On a framework or DPS the price is agreed on each call-off, so there is no award price to forecast here: the published figure is a ceiling.

About this data
  • Source. Official UK public procurement notices (Find a Tender), reused under the Open Government Licence v3.0. New notices arrive through the day; the figures are rebuilt nightly.
  • Two views, kept apart. The authority’s own track record and the wider market for the same kind of work sit side by side and are never mixed. Where the local picture is too thin, a figure widens to a broader market and says which one it used.
  • Forecasts are labelled. The price forecast and its range, possible competitors and the earlier-work matches are our estimates from past awards: not published facts, not win chances and not price advice. Official notices do not say who is bidding.
  • Every figure shows what it rests on. Not every notice publishes a bid count, a value or a delivery region, so each figure carries the number of records behind it, and one built on few records is marked as such. The on a figure explains it; the counting rules are in the methodology. Spotted something wrong? Tell us.

Contract terms
Performance terms

Appointed Companies must maintain appropriate procedures and systems to support performance monitoring and reporting under the Framework and Call-Off Contracts.

They must provide performance data in accordance with the Framework Agreement, Procurement Documents and applicable Call-Off Contract. This may include cost, time, quality, health and safety, customer satisfaction, defects, environmental performance, social value and community benefits.

Relevant and proportionate project-specific KPIs, reporting requirements and performance standards may be specified at call-off stage.

Where performance falls below the required standard, corrective or remedial action may be required in accordance with the applicable contractual terms. Further details are set out in the Procurement Documents, Framework Agreement and Call-Off Contract.

Review and risk notes
Risks

The following known risks may jeopardise the satisfactory performance of the Framework or Call-Off Contracts if they materialise and, because of their nature or uncertainty, cannot be fully addressed in the Framework as awarded:

a. material changes to legislation, regulation, statutory guidance, government policy, building standards, fire safety requirements, product standards, safety requirements or other mandatory requirements affecting the goods, works or services;

b. new or materially changed decarbonisation, energy-efficiency, environmental, net-zero or sustainability requirements affecting specifications, materials, delivery methods, reporting or compliance;

c. material changes to the lawful availability, certification, accreditation, regulatory status or technical acceptability of required products, components or materials;

d. exceptional supply-chain disruption or shortages materially affecting the availability of essential products, materials, components or specialist resources;

e. new or materially changed mandatory digital, information-management, performance-monitoring or reporting requirements;

f. material changes to statutory funding or compliance conditions directly affecting programmes delivered through the Framework;

g. material changes in demand, scope, delivery requirements or programme timing arising directly from the risks described above; and

h. unforeseen procurement, mobilisation or market disruption affecting the establishment of a replacement arrangement, where this could create a material interruption to compliant access to the goods, works or services covered by the Framework.

If a stated known risk materialises otherwise than as a result of an act or omission of LHCPG or the relevant supplier, LHCPG may consider modifying the Framework only where all applicable requirements of section 74 and Schedule 8 of the Procurement Act 2023 are satisfied.

Any modification must go no further than necessary to address the materialised risk. LHCPG must consider whether awarding a new contract would provide better value for money and whether modification, rather than a new procurement, is in the public interest. Any modification must not increase the estimated value by more than the applicable statutory limit, alter the overall nature of the Framework or extend beyond what is necessary to address the risk. It will also be subject to applicable governance, approval, record-keeping, transparency and notice requirements.

Identification of these risks does not guarantee that the Framework will be modified and does not create a general right to extend its term or increase its scope or value

Publisher note: AApplicable regime LHCPG, acting as Contracting Authority and central purchasing body for SPA, is procuring this Scotland-only Framework under the Procurement Act 2023 and Procurement Regulations 2024. Mandatory notices are published through Find a Tender; PCS publication is supplementary. Users remain responsible for requirements applicable to their Call-Off Contracts. Users and structure The Framework may be used by eligible Scottish contracting authorities and public bodies, including local authorities, social housing providers, Scottish Government bodies, NDPBs, NHS Scotland, emergency services, education bodies, eligible charities and other eligible publicly funded organisations. The Framework comprises 16 Lots across TLM5 North Eastern Scotland, TLM6 Highlands and Islands, TLM7 Eastern Scotland, TLM8 West Central Scotland and TLM9 Southern Scotland. Appointments Subject to sufficient Qualifying Bidders, LHCPG will appoint no more than 10 Appointed Companies per Lot and region. Any Micro and Small Enterprise Reserved Allocation is within that maximum. No reserve list will operate. Term and value The initial term is four years, with up to two optional 12-month extensions. The estimated maximum six-year value is 900 million GBP. Values are estimates and do not guarantee expenditure, work or Call-Off Contracts. Appointment guarantees no minimum work or value. Modifications The Framework may be modified only where permitted by section 74 and Schedule 8 of the Procurement Act 2023. Any modification must meet the applicable statutory conditions and must not alter the Framework's overall nature or require a new procurement. Documents Appointed Companies must pay the applicable LHCPG levy on Call-Off Contracts. Full requirements, evaluation, appointment, pricing and contractual terms are in the Procurement Documents. Bidders must use In-Tend to access documents, raise clarifications and submit Tenders. For more information see: https://www.gov.scot/policies/public-sector-procurement/community-benefits-in-procurement/ A summary of the expected community benefits has been provided as follows: Community benefit requirements will apply to this Framework. Bidders will be assessed on their capability and approach to delivering social value and community benefit outcomes in accordance with the strategic objectives and requirements set out in the procurement documents. Appointed Companies will be expected to work collaboratively with LHCPG, SPA and relevant Clients to identify, deliver, monitor and report proportionate community benefits linked to the scope, value, duration, location and nature of Call-Off Contracts. Specific measures, targets and reporting arrangements may be established at Call-Off Contract stage to reflect Client priorities and identified local needs.
